It looks like Sean Penn’s marriage to Robin Wright Penn is heading towards the finish line, as the Oscar-winning actor has filed for a legal separation from his missus.

48-year-old Penn together with his wife already tried to make the marriage work, but apparently failed. And finally, after 13 years of marriage, the couple are separating citing irreconcilable differences. A hearing has been scheduled for August 21.

According to court papers, the Milk actor filed the petition on April 23 in Marin County Superior Court in San Rafael, California. Well, it’s a sad fact that this is the second time where one of them filed for divorce. The first time is in December 2007, but it was dismissed since they got back together again a few months later.

Penn met Wright on the set of the 1990 Irish mob movie State of Grace. They got married in April 1996, which was a second marriage for both. Penn was previously married to Madonna, while was once married once to former soap star Dane Witherspoon. They have two children; 18-year-old daughter Dylan Francis and 15-year-old son Hopper Jack. Penn has requested of joint legal and physical custody of them.

Beside recent movie Milk, Penn had been known for several other movies, such as Dead Man Walking, I Am Sam, and Mystic River alongside Kevin Bacon. Robin Wright herself had also appeared in great movies, among them are 1999′s Message in a Bottle, supporting actress in Forrest Gump, She’s So Lovely, and New York, I Love You.
