David Duchovny wanted to make sure that the fact he’s not cheating on his wife is serious. And by serious, it means filed a lawsuit against a false fabrication story.

On Wednesday, 48-year-old Duchovny sued London-based newspaper the Daily Mail over a story the tabloid’s report last week that he cheated on his wife, Téa Leoni, with a tennis instructor, Edit Pakay. The actor filed the lawsuit in Los Angeles Superior Court, alleges defamation and invasion of privacy. Duchovny is seeking at least $1 million in damages.

The story, published last Saturday, saying that Duchovny might have an affair with his 28-year-old tennis instructor. The story said that their professional relationship quickly turned into a love match, taking a suitable tennis term. The news was soon denied by Pakay, saying that she and Duchovny were playing partners and friends, nothing more.

Former star of The X-Files, Duchovny was in the headlines a week ago when he and Leoni announced their separation. The couple have been married for 11 years, and already have two children, but apparently having an unhealthy marriage life. When they announced the separation, they were actually already separated several months ago. Although Duchovny was just released from a sex rehab clinic, but his improving life after rehab couldn’t help the broken marriage.

Duchovny currently plays a womanizing novelist on the Showtime cable television series, Californication. He is also set to star in a film called The Joneses, scheduled for release next year. Having to deal with rumors must be the least on his mind right now. A representative for the Daily Mail could not immediately be reached for comment.
